Practice Track License Terms of Agreement
This License grants the Church or Religious Institution (LICENSEE) the nonexclusive rights to to duplicate CDs and mp3s of the member publishers' works for their choir and musicians� personal practice purposes (the �Practice Tracks�). LICENSEE will be entitled to (i) use demonstration recordings provided by a member publisher; (ii) use master tracks provided by a member publisher and/or their affiliated record companies; and/or (iii) record their own demonstration recordings of the member publishers' works; however, these recordings will not be sold or licensed to third parties by the LICENSEE.
Any track reproduced under this license may be owned for life, but may not be transferred to any third party.
No material recorded under this license may be sold, rented, or distributed for any form of remuneration/gift/donation, direct or indirect. No material recorded under this license may in any way be disseminated outside the boundary or membership of the LICENSEE.
The LICENSEE also warrants that it will not in any way alter the words, music or fundamental nature of a WORK without the permission of the copyright holder.
The LICENSEE agrees to report each and every WORK reproduced under this license via the internet by logging on to OneLicense.net or by using the paper form provided for this purpose by the LICENSOR, and also agrees to carefully follow all instructions given for completing these reports.
Only Works from participating publisher members and record labels are covered by the Practice Track License.
The LICENSEE further agrees to comply with all the terms of this agreement, including the understanding that all rights are suspended and/or cancelled if the annual renewal fee is not paid prior to the expiration date, or until such fee is paid.
For purposes of payment for the Practice Tracks, the LICENSEE will purchase blocks of Credit. One Credit equals one copy of (i) an individual song, up to five minutes in length; (ii) for works longer than five minutes, one copy of each five-minute section constitutes one credit; (iii) for a complete Mass or liturgical setting, one copy shall constitute five credits.
The purchaser has one year to use the credits purchased before they expire. After one year, the purchaser will be billed for an additional year of credits, unless the purchaser cancels the Practice Track license.
Credits are priced on a sliding scale and OneLicense.net shall have the right to adjust the pricing from time to time upon written notice to the LICENSEE, however, Licensor shall honor any Payment Credits purchased for twelve (12) months.
Current pricing is:
$75.00US per year for up to 100 credits (75 cents per credit),
$150.00US per year for up to 200 credits (75 cents per credit),
$195.00US per year for up to 300 credits (65 cents per credit),
$240.00US per year for up to 400 credits (65 cents per credit),
$275.00US per year for up to 500 credits (60 cents per credit), and
$300.00US per year for up to 600 credits (50 cents per credit).
Each LICENSEE shall submit complete reports to OneLicensee.net designating each Work that was embodied in a Practice Track, the total number of copies produced, as well as the source of the recording, i.e., demonstration recordings produced by the Sublicensee, or master recordings.
No Practice Tracks will be utilized by the LICENSEE other than as set forth above, including but not limited to, a musical performance in a worship service and congregational singing.
